1 Abstract Title of the thesis: International Climate Change Law Key words: climate change, United Nations Framework Convention on Climate Change, Paris Agreement The thesis focuses on evaluation of the development of international climate change law since its beginnings with emphasis on the development in recent years. The diploma thesis is divided into an introduction, five parts and a conclusion. The first part focuses on the scientific background of climate change. The second part describes the complexity of this problem and explains the reasons for different approaches of the states to climate change. The third part deals with the subject and sources of climate law. The fourth and fifth parts are devoted to a detailed description of the development of the international climate change regime within the UN with the focus on the development after the adoption of the Paris Agreement in the fifth part.

Rhetoric of US Foreign Environmental Policy: Case Study of the Paris Agreement

The Paris Agreement represents a landmark international environmental agreement that received extensive political, journalistic, and academic attention, and the United States played a key role in the negotiation process. This thesis presents a comprehensive overview of determinants that can impact the U.S. approach to international environmental politics, and it focuses on a detailed discourse analysis of U.S. federal political elites' rhetoric on the Paris Agreement, comparing two time periods - the second term of the Obama presidency and the Trump administration. The analysis demonstrates a strong alignment of political ideology with partisanship, dividing the Democratic and Republican argumentation into rhetorical opposition, and proves the significant influence of the highly polarized two-party system on the U.S. environmental rhetoric. However, applying Putnam's two-level game framework, the case study also demonstrates that even Democratic politicians approached pragmatic rhetoric on topics such as the U.S. economy, economic growth, or U.S. leadership, and employed creative narratives that addressed the pragmatic concerns of the American public to gain support for their progressive foreign policy agenda represented by the Paris Agreement in the end result. International regime of climate protection in the light of commitments of selected Parties of the UN Framework Convention on Climate Change

Rok obhajoby: 2018 Abstract To complement the current research on countries' action in relation to global public goods, this dissertation examines the strength of UNFCCC Parties' emission commitments and the influence of selected factors derived from rationalism and constructivism on the strength of these commitments in two different contexts, under the Copenhagen Accord (2009) and the Paris Agreement (2015). Using a multiple linear regression analysis on the sample of 27 and 54 cases in the first and the second period, respectively, and as well as through case studies on three important UNFCCC Parties with a strong commitment and variance in values of the independent variables (the European Union, the Russian Federation, South Africa), the conclusions are as follows. The regression analysis in both contexts showed, in line with the assumptions, the positive influence of two factors on the strength of commitments, namely the share of alternative and nuclear energy and economic...

Legal regulation of climate protection after the Paris Agreement adoption Abstract Since the early 1990s, most of the world countries have been cooperating to create a common climate protection system, which would be effective and would help to protect the Earth ecosystem for future generations without severe and irreversible changes. After more than 20 years of difficult international negotiations without any particular outcome, the ambitious Paris Agreement on climate change was adopted in December 2015. The main aim of this thesis is to evaluate whether the Paris Agreement is a suitable instrument for climate protection and if it leads to the goals set in it. The first part of the thesis analyses the international climate protection development previous to the Paris Agreement adoption. The thesis describes the development since the cornerstones of the climate protection, over the first meteorological conferences, to the adoption of the UN Framework Convention on Climate Change and the subsequent Kyoto Protocol. It deals with the Kyoto Protocol and disappointments caused by it. Globalization and its effects on law (with emphasis on environment protection legislation)

Thesis Title: Globalization and its effects on law This thesis deals with the phenomenon of globalization and its consequences for law. Due to the fact, that the concept of globalization is very extensive, the thesis focuses only on selected aspects of law as a social phenomenon. In this sense, law is perceived as a political tool for the involvement of other subjects in its creation, which naturally leads to the disruption of the centuries-old role of the state as a hegemon of legislative norm-making. The thesis is divided into three parts, whilst the first chapter focuses on the phenomenon and genesis of globalization as such. It points to its frequent criticisms and concludes that, despite all the shortcomings, it is a very positive process, which ultimately makes the world society as a whole wealthier. Recently, however, the concept of globalization has been discussed at political levels, especially in the context of Brexit and the election of Donald Trump in 2016. The aim of this chapter is to point out the fact that even these elections need to be perceived from the perspective of disillusionment with the process of globalization and its non- economical and rather cultural aspects. Climate Policy Integration in the EU's Trade Agreements

This master's thesis deals with climate policy integration in two European union's trade agreements, EU-Canada Comprehensive Economic and Trade Agreement (CETA) and EU-Japan Economic Partnership Agreement (EPA). Ambitions of EU's climate policy have grown in recent years. Therefore the EU needs to cooperate with other world countries to tackle the climate change now even more than ever before. One of the solutions for such a binding cooperation to fight climate change could be implemented through the EU trade policy. This master's thesis is therefore interested in climate policy integration concerning the policy coherence during the process of making trade agreements and also in climate policy aspects of the final form of the agreements. In the theoretical part, this thesis describes the academic debates of policy coherence, climate policy actors in the institutional framework of the EU and also the history of EU's climate policy. Research operationalises the academic concept of climate policy integration (CPI) and carries it out through analysisand comparison of official EU's institutional documents. In the final part, this master's thesis draws its conclusions mainly from comparison of EPA and CETA.

Legal protection of the climate system of Earth in the "post-Kyoto" period

This diploma thesis focuses on the phenomenon of global climate change from the perspective of climate change law. The thesis defines the phenomenon in legal terms and deals with problems it brings to the environment and the world population. Its major part is dedicated to the international law of climate change, including all past Conferences of the Parties (COP) and their outcomes together with the most important treaties - United Nations Framework Convention in terms of Kyoto Protocol and the unsuccessful Doha Amendment. The Paris Agreement, which is the most recent international treaty, already ratified by 160 countries, could be a game changer in terms of effectivity in both climate change mitigation and adaptation legislation as well as much needed international solution. This thesis also focuses on the EU law of climate change, especially on the progress and future of Emissions Trading System and other legislation. Not only is the EU now more focused on the adaptation legislation, this is an important topic also for the Czech Republic. Especially when many Czech laws stem from EU regulations, there is still a great potential in the adaptation legislation and major progress is expected in the near future. Selected topics from climate change law with a focus on the transfer of technologies

The first chapter of this thesis discusses the recent development of climate change law. It explores the reason as to why it is at the centre of a global debate, which is predominantly due the increasingly pronounced consequences of climatic changes on human society and the environment. Furthermore, it describes the most important requirements in tackling the issues presented by international climate change treaties. This includes the United Nations Framework Convention on Climate Change, acting as a base for the whole international climate change regime, the Kyoto Protocol as a legal tool with specified emission targets and most recently, the Paris Agreement, which serves as an independent international treaty however is still under the guidance of the framework convention. The author predicts that the Paris Agreement will determine the future direction of this legal field and therefore puts particular focus on this treaty in the first chapter of the thesis. The paper aims to uncover its weaknesses - questioning the enforceability of some of the measures that rely on the autonomy of states to implement and the lack of ambition in some of its targets.
